How to enter the Korean PCT National Phase

This guide sets out the requirements for entering the national phase in India from a PCT application.

Time limits

The time limit for entering the Indian National phase is 31 months from the priority date of the PCT application.

Translation requirements

The international application must be translated into English, if applicable.

A translation of the description, claims, any tax matter of the drawings and abstract is required.

If the claims are being amended, the translation of both the original and amended claims is required. A translation of any statement under PCT article 19 must also be provided, if applicable.

The translation must be furnished in two copies.

A verification of the translation is required.

Examination

Examination must be requested by the applicant, or any other interested person within 48 months from the priority date of the application.
