This guide sets out the requirements for entering the national phase in Japan.
Time limits
The time limit for entering the national phase in Japan is 30 months from the earliest priority date.
Translation requirements
The international application must be translated into Japanese, if applicable.
The translation of the description, claims, any text much of the drawings and abstract as required. If the claims have been amended, the applicant can choose whether to file a translation of the original claims, amended claims or both.
Priority documents
If a copy of the priority documents has not been provided to the International bureau, the applicant is the opportunity to furnish a copy of the priority documents to the Japanese patent office within 32 months from the priority date.
Examination
Examination must be requested within three years of the international filing date.
Maintenance fees
Annual maintenance fees for the first to the third year this will be paid at the same time within 30 days of receipt of a decision to grant the patent.
Utility model option
When entering the Japanese national phase, the applicant may elect rather to pursue a utility model instead of a patent on the basis of the international application.
